Terms and Conditions (GTC Online Shop)

Artikel 1. Validity of the GTC and conclusion of the contract
Abschnitt 1.01 These General Terms and Conditions (GTC) apply to sales contracts with private customers concluded via the Shop website elegance-linsen.ch.
Abschnitt 1.02 These General Terms and Conditions also apply to sales contracts concluded in other ways, e.g. by telephone, e-mail or letter. If a customer does not agree with the GENERAL Terms and Conditions in such cases, he can use his right of withdrawal, see clause 7.3.
Artikel 2. Prices and special offers
Abschnitt 2.01 Prices are quoted in CHF. Shipping costs will be charged extra.
Abschnitt 2.02 Elegance Contact Lenses (www.elegance-linsen.ch) reserves the right to change prices at any time. The prices published on the website on the order date apply to the customers. The price is binding, with the reserve for obvious errors (e.g. 20.- instead of 200.-).
Abschnitt 2.03 The conditions for promotions and discounts are available from the information in question.
Artikel 3. Delivery
Abschnitt 3.01 Delivery is usually made in the delivery times specified in the product and only after receipt of the prepayment. If a longer delivery period is necessary, the customer will be informed at the latest after this period has elapsed.
Artikel 4. Shipping and shipping costs
Abschnitt 4.01 Shipping costs are not included in the shop prices. The shipping costs can be found in the shipping costs overview in the online shop. The packaging material is included in the shipping costs.
Abschnitt 4.02 Shipping usually takes place on the next business day after receipt of payment.
(a) Goods with stock: 1-3 days (A-Post)
(b) Goods with arrears: 7-14 days
Abschnitt 4.03 If the goods are shipped uninsured by post, the risk of loss by post lies with the buyer.
Abschnitt 4.04 Your goods will be shipped by Swiss Post. Unless otherwise agreed, the goods will be shipped by A-Post (Switzerland: package up to 2 kg A-Post CHF 9.00
Artikel 5. Right of withdrawal and withdrawal
Abschnitt 5.01 Customers can withdraw from the purchase agreement within 7 days without giving reasons and without penalty. The period for exercising this right begins on the day on which the goods arrive at the consumer. The customer can return goods that have already been delivered at his own expense. Payments already made will be refunded by the supplier minus shipping costs
Abschnitt 5.02 If a customer withdraws from the purchase due to defects in the goods or other reasons for which the supplier is responsible, the supplier will refund amounts already paid.
Abschnitt 5.03 If the customer wishes to withdraw from his order, the customer must report in writing within 5 days otherwise the standard conditions apply and the customer must pay the invoice, even if he/she has not yet received the goods because his/her creditworthiness did not allow them to send them in advance. Personal reasons justify ordering and do not pay, the customer must take responsibility.

Artikel 6. Return
Abschnitt 6.01 You have an unlimited right of return of the total delivery within 7 days of the delivery date. This applies to the entire delivery and all goods received. The goods must be returned in unused, undamaged condition in undamaged packaging to the sender of the delivery (usually elegance-linsen.ch). In the case of hidden defects, these must be notified in writing, otherwise no credit or replacement delivery can be made. A claim to a credit is created.
Artikel 7. Liability and warranty
Abschnitt 7.01 The buyer must inspect the delivered goods as soon as possible and report defects immediately. Secret defects can still be objected to after commissioning or use of the goods. The performance of payments shall not be deemed to be a waiver of notice of defects.
Abschnitt 7.02 If there is a defect, the buyer has the choice to demand free repair, to withdraw from the contract or to obtain replacement delivery. The buyer's right to claim damages is reserved in all cases.
Artikel 8. Payment
Abschnitt 8.01 Payment is usually made against advance payment, Postcard or credit card, Paypal.
Abschnitt 8.02 In case of late payment, Elegance Contact Lenses (www.elegance-linsen.ch) will send a maximum of two reminders. A fee of CHF 20.- will be charged for the second reminder. If the customer does not pay, enforcement measures are initiated. In addition, default interest of 5 percent will be charged in case of late payment. Claims for damages are reserved.

Artikel 9. Payment
Abschnitt 9.01 Orders are binding, you must understand that sent orders are binding, even if your creditworthiness does not allow us to send the products on account you have to pay the invoice. After that, you will receive your products as desired.
Abschnitt 9.02 We only send the products to new customers on account, the credit check positive has fallen.

Artikel 10. Liability for online connections
Abschnitt 10.01 Elegance Contact Lenses (www.elegance-linsen.ch) undertakes to ensure security according to the current state of technology and to comply with the rules of data protection in systems, programs, etc. that belong to it and over which it has influence.
Abschnitt 10.02 Customers must ensure the security of the systems, programs and data that are within their control. Customers should keep passwords and usernames secret from third parties in their own interest.
Abschnitt 10.03 Elegance Contact Lenses (www.elegance-linsen.ch) are not liable for defects and faults for which it is not responsible, in particular for safety defects and operational failures of third parties with which it cooperates or on which it is dependent.
Abschnitt 10.04 Furthermore, Elegance Contact Lenses (www.elegance-linsen.ch) shall not be liable for force majeure, improper action and disregard of the risks on the part of the customer or third parties, excessive use, unsuitable equipment of the customer or third parties, extreme Environmental influences, customer intervention or interference by third parties (viruses, worms, etc.) that occur despite the necessary current security precautions.
Artikel 11. Application of the law and place of jurisdiction
Abschnitt 11.01 It applies to all deliveries, within Switzerland and also abroad, exclusively under Swiss law. The place of jurisdiction is Dietikon, resp. The registered office of the sub-supplier.
Abschnitt 11.02 Our debt collection partner is Intrum AG in Schwerzenbach,
Intrum AG is authorized to collect all mandates handed over within the scope of the general business regulations.
